Under a fixed term agreement the term of the agreement is binding to both landlord and tenant.  We understand that sometimes life can throw curves balls and tenants find themselves caught in a situation that requires them to vacate the property early.

Where the agreement is for a fixed term and the tenant vacates before the expiry date, the landlord can claim for the loss incurred as a result of the early abandonment.  Renting Adelaide are here to help you navigate this process as best as possible.

If you find yourself in a position where you may need to break your tenancy agreement and vacate prior to the fixed term expires, please make sure you FIRST contact your property manager to discuss the best course of action and the process required in more detail.  This can quickly help diffuse any anxiety or stress about the process and also ensure transparency and clarity about the pathway forward.

Common questions that arise during this process are relatively easy to navigate, and often a phone call is the best way to cover this ground effectively.

THE ADVERTISING: 
We have a fantastic process in place to minimise this expense, maximise exposure and achieve the best result.  Advertising on facebook, gumtree or similar is fraught with danger for many reasons, so please leave this to our expert team.  Whilst it may seem beneficial to utilise these platforms it is more often than not a hinderance and simply makes the process harder and counter productive.

BREAK LEASE FEES: 
It's important to note that you may only be liable for only for a portion of these expenses and our role is to keep this cost as low as possible.
Our team have had great success in navigating the break of lease situation many times over, whereby the tenants has zero out of pocket expenses, and the key to this success is to trust in our ability and work closely with the team to achieve this outcome.

THE NEW CONTRACT:
Just remember we can ONLY have one (1) Tenancy Agreement on a single property at any given time.  This means another tenancy agreement cannot be signed until your tenancy has ended and with the right approach this can be achieved with minimum vacancy and even less stress.

THE FINAL INSPECTION:
It is a legal requirement that an inspection is completed prior to each new tenancy agreement commences and this can only be done accurately when the property is fully vacated.  This process does require some time to complete and therefore does need to be considered in the re-letting process.

YOUR SAFETY AND SECURITY:
Your safety safety and security is paramount, and the manner in which the property is advertised and inspections are carried out is crucial to maintaining your right to safety and privacy.  WE DO NOT advertise your property on social media websites (nor should you) as this process is extremely risky and can expose you and your family to scammers and identity fraud which is avoidable.

YOUR BOND:
Your bond is the last piece of the puzzle and our objective is always to have this fully refunded to you in full as the last step in the process.  This is absolutely achievable, provided there are no hidden surprises or delay's in delivering up the property in the clean and tidy condition the new tenants (and landlord) would expect.

The more information and transparency you provide your property manager, the less stressful the situation will be for all parties involved.

A tenant cannot end a fixed term lease early without being held responsible for costs related to reletting the property, unless the landlord/agent agrees not to claim these costs. Make sure any agreement not to claim costs is in writing.

If a tenant moves out of the property before the end of a fixed term agreement, they are breaking the lease and a landlord can claim costs for:

  • loss of rent until the property is re-let
  • advertising
  • re-letting – fee charged to the landlord by an agent

If your tenancy agreement has no fixed end date, then you are likely subject to the terms of a Periodic Tenancy Agreement (month to month) and the period of written notice that you need to provide the landlord is between 21 and 28 days notice, depending on your payment cycle.
